1. SALE CONTRACT
a) When you place an order for any material or product (in this agreement 'resources') by submitting an order form on the website your contract with us will commence when we, Victory Tracts & Posters , confirm acceptance of your order by automatic email and by letter ('Contract''). We agree we will supply the resources listed on the said order confirmation. If you place an order by telephone, the contract commences at the close of that conversation. If you write or fax us, the contract starts upon our receipt of your communication.
b) These Terms and Conditions shall govern the Contract to the exclusion of any other Terms and Conditions. Failure by Victory Tracts & Posters to enforce any of these Terms and Conditions will not affect our right to enforce the rest of these Terms and Conditions.
c) Any advice or recommendations given by any representative of Victory Tracts & Posters to you relating to resources, which is not confirmed in writing by Victory Tracts & Posters will not be binding on Victory Tracts & Posters.
d) Variations to these general Terms and Conditions may from time to time be made available on the website. Specific variations for a particular contract are only valid if confirmed in writing by the Director of Victory Tracts & Posters
2. ORDERING
In submitting an order you acknowledge that:
a) All information and specifications relating to the resources produced by any supplier represented on the website are approximate and Victory Tracts & Posters is not responsible for the accuracy of content provided. Covers may vary from those displayed on the website because of monitor and printer capabilities and last minute changes made by publishers.
b) Victory Tracts & Posters may make any changes to the specification of the resources to conform to any statutory or European requirements.
3. PRODUCT DESCRIPTION
We attempt to be as accurate as possible. However Victory Tracts & Posters does not warrant that descriptions of resources or other content of this website are accurate, complete, reliable, current, or error-free. Your sole remedy, should resources be other than described on the website, is to return the resources in an unused state.
4. PRICING POLICY
a) The price of the resources shall be the price as quoted on the website on the date the order was placed, subject to any inadvertent pricing errors (whether technical or otherwise) by Victory Tracts & Posters.
b) The price of the resources will be subject to a handling charge for small orders with a gross total value of under £10.00 Sterling or such other amount as we may decide from time to time and post on the order page of the site.
c) The price of the resources does not include the cost of delivery to destinations outside of the United Kingdom. For such orders, you will pay the delivery charges as quoted on the website on the day of purchase.d) The price of the resources includes any applicable Value Added Tax, which you shall be liable to pay to Victory Tracts & Posters.
5. CREDIT CARDS
a) Credit and debit cards accepted by Victory Tracts & Posters are listed on the website.
b) All payments by credit or debit cards will be taken prior to dispatch of the resources. Any fraudulent use of credit or debit cards will be notified to the authorities along with any identification details that were supplied with the order.
c) Any refund made to your credit or debit card shall be subject to the terms and conditions of the relevant issuing bank and therefore be subject to any time delay as specified by the issuing bank. We will not be liable for any delay that is outside our control. A correct cardholder name and address must be supplied at the time of ordering where it is different from your name and address.
6. DELIVERY
a) If you do not take delivery of the resources or fail to give Victory Tracts & Posters adequate delivery instructions we shall not be liable for any loss or damage or deterioration to the resources delivered.
b) If you do not receive all the goods as specified on your original order then you must notify Victory Tracts & Posters in writing within 14 working days from the date of delivery. If you do not inform Victory Tracts & Posters in writing within the specified time then no liability will be attached to Victory Tracts & Posters. In any event any loss or damage you suffer as a result of such a delivery shall be limited to the price of the goods not delivered or the cost of replacement resources.
c) Risk of loss and title of the resources pass to you on delivery by us to the relevant carrier.
7. RIGHT OF CANCELLATION
You have the right to withdraw from the contract within 7 working days of acceptance by us of your order for the resources by giving us written notice of withdrawal. Victory Tracts & Posters shall credit your credit or debit card for the price of the cancelled order. Any credit will include any charges we made against small orders and any postage charge levied. If resources have been dispatched before this period elapses, refunds will be delayed until the resources are returned to us in saleable condition. We reserve to charge a nominal restocking charge at our discretion to cover any loss we suffer in this circumstance.
8. WARRANTY
Subject to clause 14 below Victory Tracts & Posters warrants that the resources will correspond with the order at the time of delivery and will be free from defects on delivery. If Victory Tracts & Posters is in breach of this warranty you shall notify Victory Tracts & Posters within 14 working days from the date of discovery of the defect. On receiving a notice of failure of warranty Victory Tracts & Posters may, at its sole option either replace all the faulty resources or refund the price of the resources that are defective.
9. EXPORT TERMS & VAT
Victory Tracts & Posters will be pleased to arrange for export shipping of any of our resources. Unless we arrange shipping with a recognised company we will charge VAT. We will provide you with the necessary paperwork to claim the VAT back on any personal exports at the point of departure from the UK.
10. TITLE
Title to the resources supplied by us passes only when payment is received in full for the resources and any charges the customer incurs. Payment received after 30 days from date of invoice will be used first to cover the overdue interest charged, and any remaining funds to reduce the balance for resources supplied. Interest will be charged at 5% per month. We reserve the right to pass details of accounts over 60 days late to a credit collection agency.
11. WITHDRAWAL OF RESOURCES
Victory Tracts & Posters may withdraw the sale or distribution of any resources produced by or generally supplied by Victory Tracts & Posters without prior notice, or liability, to you.
12. COPYRIGHT
All material included on this site including but not limited to graphics, logos, icons, text and software is the property of Victory Tracts & Posters or its content providers and is protected by UK and international copyright laws.
13. ACCESS TO THE WEBSITE
Victory Tracts & Posters grants you the right to use this website for your personal use but not to download or modify it or any part of it except with our prior written consent. This licence does not include any resale or commercial use or derivative use of the website or its contents. No part of the site may be used for commercial purposes without the express written consent of Victory Tracts & Posters or through participation in an affiliate scheme authorized by Victory Tracts & Posters.
14. DISCLAIMER AND LIABILITY
a) This website is provided by Victory Tracts & Posters on an "as is" basis. We make no representations or warranties of any kind express or implied as to the operation of this site or the information content materials or products included on this site. You agree that your use of this site is at your sole risk.
b) To the full extent permissible by applicable law Victory Tracts & Posters disclaims all warranties express or implied including but not limited to implied warranties of merchantability or fitness for a particular purpose.
c) Victory Tracts & Posters does not warrant that this website, its servers ,or an e-mail sent from Victory Tracts & Posters is / are free from viruses or other harmful components.
d) Victory Tracts & Posters will not be liable for any damages of any kind arising from the use of this website including but not limited to damages for consequential loss.e) These exclusions of liability will not apply to any damages arising from death or personal injury caused by the negligence of Victory Tracts & Posters, or any of its employees or agents.
15. APPLICABLE LAW
The Contract and these Terms and Conditions shall be subject to English law and the parties submit to the non-exclusive jurisdiction of the English Courts.
